Nature and scope of the service/Contractual relationship
GetByTransfer is the trading name of SOL ITUM d.o.o., which is a company registered in Croatia, whose registered office is at Lovački put 1A, 21 000 Split, Croatia (“We”, “Us”, “GetByTransfer”).
These Terms and Conditions (“Terms”) together with your Booking made in accordance with these Terms, constitutes a contract for the Services between You and the Transport Service Provider which is entered into by You and by us acting as an agent for and on behalf of the Transport Service Provider. We are not responsible for, and shall have no liability in respect of, any acts of omissions of the Transport Service Provider including, without limitation, any failure or delay to supply the Services or otherwise affecting the Journey which is caused by the Transport Service Provider.
These Terms shall apply to all contracts for the provision of our Services to the exclusion of all other terms and conditions.
No conduct by GetByTransfer shall be deemed to constitute acceptance of any other Terms.
You will have made us, acting as an agent for and on behalf of the Transport Service Provider, an offer to purchase the Services once You have clicked “Book Now”. We will have accepted this offer, for and on behalf of the Transport Service Provider, once we have received the necessary credit card pre-authorization (if applicable) and have emailed your Booking Confirmation to you.
The Terms may be changed from time to time and will be updated on our Website, You are advised to check the Website to consider any changes to the Terms which apply to You and/or any Passenger.
Without prejudice to the provisions of clause 1.6, your purchase of the Services and the provision of the Services is subject to the corresponding laws of the country and/or state in which the Journey takes place.
The Terms apply to any Booking that You make on or through the Website.
Your Booking on the Website is conditional upon You accepting the Terms. If You do not agree with any part of them, You must not proceed with your Booking. By confirming that You wish to book the Services through the Website, You indicate that You have read and understood and accept the Terms. In case You consider any provision or statement listed in these Terms unclear or if you are uncertain whether it applies to You, or have a query regarding the Services, we strongly recommend contacting us.
Textual, photographic, video and other information on the Website are provided for illustrative purposes only. It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all information provided on the Website.
You: Refers to You, the person who makes the Booking.
GetByTransfer, Us, We: Refers to GetByTransfer, acting as a mediator Platform in the provision of Services between You and the Transport Service Provider.
Booking: Refers to the booking of a Journey forming a part of the Services.
Driver: Refers to the person(s) responsible and assigned by the Transport Service Provider for driving the Vehicle for the Journey.
Drop Off Location: Refers to the location (address) outlined in the Booking that defines where the Journey will end.
Pick Up Location: Refers to the location (address) outlined in the Booking that defines where the Journey will begin.
Pick Up Time: Refers to the time (local time) outlined in the Booking that defines when the Journey will begin.
Wait Time: Refers to the waiting time after the Pick Up Time defined in clause 6.3, 6.4.
Journey: Refers to the travel between the Pickup Location and Drop Off Location by the Transport Service Provider.
Passengers: Refers to the person(s) who are a part of the Journey (including You if applicable).
Services: Refers to the organisation and supply of a Vehicle and Transport Service Provider to conduct the Journey.
Transport Service Provider: Refers to the supplier of Driver and Vehicle assigned to a Booking who will be responsible for completing the Journey. The details of whom will be forwarded to You upon confirmation by the Transport Service Provider.
Vehicle: Refers to the vehicle assigned to the Journey by the Transport Service Provider, and used for the Journey.
Contact Information: Refers to the email address, and the mobile number provided during the Booking by You.
Website: Refers to the web page www.getbytransfer.com and all web pages owned by GetByTransfer.
Pre-authorization: Refers to a temporary hold on the full amount chargeable for your Booking. This amount is automatically released after the conclusion of your Journey.
We will provide the Transport Service Provider with the details of the Booking.
Once we have received confirmation from the Transport Service Provider that your booking can be fulfilled, we will send You a confirmation email with your Journey details, Confirmation and contact details of the Transport Service Provider to the email address given during the booking process.
We will strive to ensure that the Transport Service Provider assigns the Vehicle requested in the Booking to complete your Journey, although we are unable to guarantee the make and model.
You must ensure that you have provided us with full and accurate details of the requirements for your Booking, including, but not limited to, accurate timings for Pick Up Time (local time), Pick Up Location, Drop Off Location and Flight Number, Train Times or Ferry Times (where applicable).
You must ensure that you confirm that your Booking details are complete and accurate.
You must ensure that you have allowed sufficient time to reach your destination when arranging the Pick Up Time of your Journey, taking into consideration the possibility of delays, weather conditions or local events. Furthermore, taking into consideration the time required prior to an international departure flight.
Subject to clause 6.3, and 6.4, You must ensure that You, and the Passengers are at the Pick Up Location at the Pick Up Time.
You must provide Us with valid Contact Information to enable us to contact You if necessary and provide you with information regarding your Booking.
You must ensure that You have a mobile phone, with the contact number You have provided, switched on at the Pick Up Time and during the Wait Time (as defined in clause 6.3, and 6.4).
You must ensure that any Passenger under the age of 16 is accompanied by a responsible adult.
All Passengers must be fit to travel. Drivers, acting reasonably, reserve the right to refuse Services to any person who is considered unfit to travel, or who is abusive, intoxicated, underage, or if carriage of any such Passengers and/or luggage would cause the Driver to be in breach of any applicable traffic and/or road safety regulations, or may damage the vehicle.
You are responsible for ensuring that the Passengers comply with all provisions of the Terms where necessary or required to enable You to comply with the Terms, and You shall be liable for acts and omissions of the Passengers.
Price and payment
All tolls, taxes and city fees are included in the price quoted on the Website and shown in the Booking. Any additional tolls, congestion charges, city fees, or taxes arising out of changes to the journey decided upon by You and/or any Passenger after the beginning of the Journey and confirmed with the Driver and/or Transport Service Provider must be paid by You or the Passenger, as appropriate.
We will pre-authorize (a temporary hold on the full amount chargeable for your Booking, but no funds will be debited from your account at that time) when we receive your Booking.
Payment for the Booking will be handled with the Driver and/or Transport Services Provider at the conclusion of the Service.
Gratuity is not included in the price quoted on the Website or shown in the Booking. Gratuity is up to the discretion of You and/or the passenger, as appropriate.
You and/or the Passengers may be charged if changes are made to your journey after you have been picked up by the Driver. Such changes and additional charges will be agreed locally with the Driver and/or Transport Service Provider. The Driver and/or Transport Service Provider reserves the right to decline any unreasonable request to amend the Journey. Neither we, nor the Driver or Transport Service Provider shall have any liability to You if You request changes to the Journey that are not acceptable during your Journey.
You must ensure that, at the Pick Up Time and during the Wait Time on the day of your Service, You have a mobile phone that is switched on and reachable using the contact number provided during the booking process.
If the Pick Up Location is not easy to locate or apparent from the road, You must provide additional details to assist the Driver in locating You and/or the Passengers. This information can be entered in the “Comments” box on the Website, and should include any relevant information that may assist the Driver and/or Transport Service Provider.
The Vehicle and Driver will wait for You and/or the Passengers for up to 45 minutes where the Pick Up Location is at an airport. The Transport Service Provider will monitor any flight delays, and the Wait Time will be extended for any delays.
The Vehicle and Driver will wait for You and/or the Passengers for up to 15 minutes where the Pick Up Location is at any location other than an airport.
Each passenger is entitled to one travel bag/suitcase and one hand luggage item (such as a handbag). Suitcases shall not exceed 70cm/27inches in length. Hand luggage shall not exceed 50cm/22inches in length. Any oversized items, or additional luggage should be declared in advance via "Comments" box on the Website or by contacting the GetByTransfer Customer Support Team. Non-standard luggage (including, but not limited to; bicycles, skis, golf-clubs, surfboards) may be subject to additional charges.
If Passengers are unable to meet the Vehicle and Driver at the Pick Up Time is essential that You contact us, or the Transport Service Provider, as soon as possible to request to amend the Pick Up Time. You acknowledge that both us, and the Transport Service Provider reserves the right to decline any unreasonable amendments to the Pick Up Time and/or Journey.
Neither we, nor the Transport Service Provider, are responsible for failed Journeys if the details You have provided in the Booking are incorrect.
As the Transport Service Provider will have allocated a Vehicle and a Driver to a Booking, the Driver will have incurred time travelling to and waiting at the Pickup Location, You acknowledge and accept that in the event of a failed journey due to:
Incorrect Pick Up Location and/or Journey details being provided to us during the booking process;
You and/or the Passengers failing to be at the Pick Up Location at the Pick Up Time or before the end of the Waiting Times referred to in clauses 6.3 and 6.4;
You and/or the Passengers failing to rearrange a Pick Up Time in accordance with these Terms;
Any other cause by You or the Passengers;
You may be charged for the complete Journey in accordance with clause cancellation and neither we not the Transport Service Provider shall have any liability whatsoever to You or any Passenger in respect of the failed Journey or Booking.
If You or any Passengers have any special requests relating to the Booking, this should be notified to our Customer Support Team at the time of the Booking or via email. Please note that any special requests can not be guaranteed.
Any additional charges incurred as a result of any Special Requests will be notified to you by our Customer Support Team for You to approve.
If You or the Passengers wish to make changes, you must contact our Customer Support Team who will act as an intermediate between You and the Transport Service Provider.
Our Customer Support Team will inform you of the outcome of your requested amendment.
Any additional charges incurred as a result of any amendments will be notified to you by our Customer Support Team for You to approve.
You may cancel a Booking by sending the GetByTransfer Customer Support Team an email expressing your wishes to cancel your Booking.
If You cancel your Booking, the cancellation and pre-authorized credit card, will be subject to the cancellation charge(s) below:
Time of cancellation
More than 5 days prior to Pick Up Time
Between 5 days and 24 hours prior to Pick Up Time
Within 24 hours prior of Pick Up Time
We reserve the right to cancel the Booking upon limited or immediate notice in any circumstances. In circumstances where we cancel the Booking due to issues related to the Transport Service Provider and/or the applicable vehicle which was assigned to the Journey we will use reasonable endeavours to arrange for the supply of an alternative vehicle when possible. In circumstances where we cancel Your booking, your Booking will not be subject to any cancellation charges and/or fees.
If You, or any Passenger, are not satisfied with the Booking or the Journey in any way, shape or form and You wish to make a complaint, You should report this to the GetByTransfer Customer Support Team as soon as possible.
Limitations of liability
If We fail to comply with our obligations under the Terms, we may be responsible for loss or damage You suffer that is a foreseeable result of our failure or our negligence, but we are not responsible for any loss or damage that is not foreseeable.
Subject to clause 10.4, neither we nor the Transport Service Provider shall be liable to You or any Passenger, whether in contract, tort (including negligence), breach of statutory duty or otherwise for any indirect losses of whatever nature, whether or not they arise out of any other loss or damage suffered by You or any Passenger. Furthermore, neither We nor the Transport Service Provider shall be liable for any loss of profits, loss of opportunity, loss of goodwill or consequential losses, damages or costs.
Subject to clause 10.4, the aggregate limit of our liability and the Transport Service Provider’s liability to You and any Passengers, however arising under the Terms of in respect of a Booking or Journey shall in no circumstances exceed the cost of the Booking.
Nothing in the Terms exclude or limit liability for (i) death of personal injury caused by the negligence of the liable party, or (ii) fraud or fraudulent misrepresentation, or (iii) or any other liability which cannot be limited or excluded by applicable law.
Events outside of our control
A “Force Majeure Event” refers to any event that is unforeseen or otherwise beyond the control of the party in question, including, but not limited to strikes, lock-outs, act of God, war, riot, civil commotion, fire, flood, storm, unavoidable technical problems with transport, closure or congestion of airports, ferry ports or other locations, cancellation or diversion of flights.
Neither We nor the Transport Service Provider shall have any liability for or in respect of any failure to perform or delay in performing any of our respective obligations pursuant to a Booking, a Journey or these Terms if delayed, hindered or prevented by a Force Majeure Event.
In the case of Vehicle malfunction it is the responsibility of the Transport Service Provider to make all necessary arrangements to ensure that the Journey is completed as soon as possible.
Website conditions of use
Any usage of the Website or its contents for any purpose other than Booking Services is prohibited. Including, but not limited to, any commercial or competitive use, interfering, or attempting to interfere with the normal workings of the Website. The Website and all of its contents are protected by industrial and intellectual property rights and are exclusively owned by the SOL ITUM d.o.o. company.
Law and jurisdiction
To the fullest extent permitted, the Terms are governed by the laws of Croatia, and all parties shall be subject to the non-exclusive jurisdiction of the courts of Croatia.
